J-1 Visa

The J-1 classification, or exchange visitor status is a non-immigrant visa and it is granted to individuals participating in approved programs for purposes such as teaching, studying, conducting research, or receiving training. The U.S. Department of State designates public and private entities as exchange sponsors, responsible for overseeing J-1 nonimmigrants. These programs aim to facilitate the exchange of individuals, knowledge, and skills in areas like education, arts, and science.

Examples of exchange visitors include, but are not limited to:

  1. Professors or scholars
  2. Research assistants
  3. Students
  4. Trainees
  5. Teachers
  6. Specialists
  7. Au pairs
  8. Camp counselors

Certain J-1 visa programs are subject to a 2-year foreign residence requirement. If the program or skill set falls under this requirement, the applicant must return to their home country for 2 years before being readmitted to the U.S. under another visa category or changing their status within the U.S. To return to the U.S. under a different visa or change status within the U.S., the individual needs a waiver to lift the 2-year requirement. Notably, individuals applying for a Green Card before fulfilling the 2-year requirement are not eligible to change their status to Lawful Permanent Resident.

Duration: The duration of your stay in J-1 exchange visitor status depends on the required time to complete the exchange program. Typically, you are granted the time specified for your program’s completion.

Family Members: The applicant’s spouses and unmarried children under the age of 21 are eligible to accompany the applicant as dependents on J-2 status.
