The E-3 non-immigrant visa classification is exclusively for Australian nationals. The purpose of coming to the United States must be solely to provide services in a specialty occupation. This occupation necessitates the application of advanced and specialized knowledge, both theoretically and practically. A minimum requirement for entry into the occupation in the United States is the attainment of a bachelor’s or higher degree in the specific specialty, or its equivalent.
To be eligible for an E-3 visa, you need to show, among other requirements, that you:
- Hold Australian citizenship.
- Have a valid job offer in the United States.
- Possess the required academic or qualifying credentials.
- Will be occupying a position that meets the criteria for a specialty occupation.
Duration: The initial duration of stay can be a maximum of two years. Extensions of stay are allowed for up to 2 years per extension, with no maximum number of extensions, except for some specific cases.
Family Members: An E-3 nonimmigrant worker’s spouse and unmarried children under 21 years of age are entitled to dependent E-3 classification.
