K1 visa is a nonimmigrant visa to Initiate the process to bring a foreign fiancé(e) to the United States for marriage. To be eligible for the K-1 visa, both parties must have the genuine intention to marry within 90 days of the fiancé(e)’s entry into the U.S. under the K-1 status. The marriage must be a sincere commitment to building a life together, and not solely for obtaining immigration benefits.
Eligibility for a fiancé(e) visa (K-1) is contingent on the following criteria:
- The petitioner must be a U.S. citizen.
- Both the petitioner and the fiancé(e) must have the intention to marry within 90 days of the fiancé(e)’s entry to the United States on a K-1 visa.
- Both parties must be legally free to marry, with any prior marriages legally terminated.
- The couple must have met in person at least once within the 2-year period before filing the petition. A waiver of this requirement may be requested under specific circumstances, such as cultural customs or extreme hardship to the U.S. citizen petitioner.
Children of Fiancee: Unmarried children under the age of 21 may accompany fiancées on K-2 visa status.
